Terms and Conditions

1. The Service

MakeMyAdvert provides tools that help users create video advert concepts, prompts, storyboards, revisions, generated media, and rendered outputs using AI systems and third-party generation providers. We generate and privately deliver the file to you. The current role description is a draft pending legal approval: MakeMyAdvert is the provider of the user-facing and generative AI service, while you are responsible for claims, endorsements, targeting, placement, publication, and other duties that arise from your campaign. Features may change, be suspended, or be withdrawn as the service evolves.

2. Accounts

• You must provide accurate account information and keep login credentials secure.
• You are responsible for activity that happens through your account.
• You must be at least 18 years old, or the age of majority in your location, to use MakeMyAdvert.
• We may suspend or close accounts that breach these terms, create risk, or misuse the service.

3. Your Content

You retain whatever rights you already have in prompts, briefs, files, images, video, audio, documents, brand materials, and other content you submit. You grant MakeMyAdvert the rights needed to host, process, analyse, transform, transmit, generate, display, and store that content so we can provide the service. You remain responsible for having the necessary rights and permissions for your inputs and for the campaign decisions and publication activities you control. Nothing in these Terms limits obligations that cannot lawfully be excluded.

4. Content Responsibilities

• You must have the rights, permissions, and legal basis to upload and use all submitted content. It is your sole responsibility to ensure you have obtained all necessary permissions, licenses, consents, and rights to use and submit any content (including images, logos, video, audio, or text) to our service.
• You must not submit content that infringes intellectual property, privacy, publicity, confidentiality, or contractual rights.
• You must not submit unlawful, harmful, abusive, exploitative, deceptive, or malware-related content.
• You are responsible for reviewing generated outputs before publishing, distributing, or relying on them.
• Before publication, you must review the advert's claims, endorsements, targeting, placement, and any disclosure duties that apply to your intended audience, channel, and market.

5. AI Outputs

AI-generated outputs may be inaccurate, incomplete, unexpected, similar to outputs generated for others, or unsuitable for a particular use. You must review generated outputs before publication. We provide first-interaction notices and first-exposure notices where required; these Terms are additional information and do not replace those notices. We may apply machine-readable AI provenance and visible AI-generated labels to outputs, and retain related provenance evidence. You must not remove, obscure, alter, bypass, or otherwise circumvent those markers or labels, including when editing, exporting, distributing, or publishing an output.

6. Credits, Charges, And Approval

• Credits are used to request paid generation or rendering work.
• Where the workflow offers a review step, a credit should only be charged when you approve submission for generation or rendering.
• Credit prices, bundles, subscriptions, and included usage may change over time.
• Failed generations may be retried or refunded at our discretion, depending on the cause and system records.
• Unused credits may expire or be limited where required by the offer, subscription, or applicable law.

7. Payments And Subscriptions

Payments are handled by third-party payment processors. You agree to provide accurate billing details and authorise applicable charges, including recurring subscription charges where selected. Taxes, currency conversion, payment failures, chargebacks, and processor rules may affect billing and access.

8. Messaging And Chat Workflows (WhatsApp / WeChat / Weixin)

If you use WhatsApp or other messaging platforms (such as WeChat or Weixin) with MakeMyAdvert, you consent to receiving service messages, advert review summaries, approval requests, revision replies, and render status updates through these channels. You are fully responsible for ensuring that any media or instructions sent through chat channels are lawful, authorized, and suitable for AI processing.

9. Acceptable Use

• Do not attempt to bypass credits, rate limits, security controls, or access controls.
• Do not reverse engineer, overload, scrape, resell, or misuse the service.
• Do not strip, obscure, alter, or circumvent machine-readable AI provenance, visible AI-generated labels, or related technical controls.
• Do not use MakeMyAdvert to create misleading, illegal, discriminatory, unsafe, or rights-infringing advertising.
• Do not upload real people, faces, likenesses, or personal data unless you have all required permissions and the generation provider allows that use.

10. Third-Party Services

MakeMyAdvert relies on third-party services, including AI model providers, video-generation providers, hosting infrastructure, payment processors, authentication providers, and communications platforms. Their own terms and policies may apply. See our Privacy Policy for the current named AI processors and a description of processing.

11. Availability

We aim to provide a reliable service, but MakeMyAdvert may be interrupted by maintenance, provider failures, rate limits, moderation decisions, network issues, or operational incidents. We do not guarantee uninterrupted availability or that every generation request will succeed, subject to rights and obligations that cannot lawfully be excluded.

12. Intellectual Property

MakeMyAdvert, its interface, code, workflows, designs, branding, documentation, and underlying systems are owned by us or our licensors. You may not copy, reproduce, or exploit them except as allowed by these terms or with written permission.

13. Disclaimers

The service is provided "as is" and "as available" to the extent permitted by law. Nothing in these Terms excludes or limits MakeMyAdvert's non-excludable provider, privacy, safety, consumer-law, or other legal obligations.

14. Liability

Any limitation of liability applies only to the extent permitted by applicable law and does not exclude or limit MakeMyAdvert's non-excludable provider, privacy, safety, consumer-law, or other legal obligations.

15. Termination

You may stop using the service at any time. We may suspend, restrict, or terminate access if you breach these terms, create risk for MakeMyAdvert or others, fail to pay, or misuse the service. Some provisions will continue after termination where needed to give effect to these terms.

16. Changes

We may update these terms from time to time. Updated terms will be posted on this page with a new effective date. Continued use of the service after changes means you accept the updated terms.
